A few days ago we mentioned that it was reported that Lindsay Lohan was probably going to skirt by without any felonies from her DUI and cocaine possession arrests. TMZ was at the courthouse when the decision was announced. Instead of the felonies, which could have sent her to prison, she received seven misdemeanor counts.
Lindsay’s seven counts included two counts of driving under the influence, two counts of driving with a blood-alcohol level over 0.08 percent, two counts of being under the influence of cocaine, and one count of reckless driving.
Apparently, several things worked in Lindsay’s factor. According to the D.A. there was not enough cocaine found to warrant a felony and the methods with which the cocaine was seized were questionable. Other things that helped Lindsay include a poor family upbringing, her age, the fact that she was busted so close together, and the fact that she checked into rehab immediately after being caught both times.
A law enforcement source told TMZ, “There are lots of kids struggling with addiction. The first sign of trouble usually involves a car. We’re not going to throw every one of them in prison. It doesn’t make sense.”
Apparently, it only makes sense if you’re not a celebrity or if the D.A. wants to make an impact like in lesser cases concerning people like Paris Hilton, Nicole Richie, or Robert Downey Jr.
